1. About This Service

("the Platform", "we", "us") is an AI-powered audio and video transcription service operated by Always Green Dev. We provide automatic speech recognition, YouTube SEO content generation, and related tools to registered users via a credit-based billing model.

By registering, funding your account, or using any feature of the Platform, you accept these Terms in full. If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old and legally capable of entering a binding contract under Nigerian law to use this Platform. You may not register on behalf of another person without their consent. Businesses may register using a company email, but an individual must accept responsibility for the account.

3. Account & Security

You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately if you suspect unauthorised access. We are not liable for any loss resulting from your failure to keep your account secure.

We reserve the right to suspend or terminate accounts where there is evidence of fraud, abuse, or breach of these Terms.

4. Credits & Payments

How credits work. Transcription and SEO generation features are charged in credits. The exchange rate between Naira and credits is set by the platform and shown clearly before each payment. One credit does not equal one Naira — the rate is configured by the platform operator.

Top-ups. Credits are purchased in Naira via Paystack. The minimum top-up amount is displayed on the funding page. Payments are processed by Paystack in accordance with their terms; we do not store your card details.

No refunds on credits. All credit purchases are final and non-refundable once added to your account, except where required by Nigerian consumer protection law. Unused credits do not expire, but may be forfeited if your account is terminated for breach of these Terms.

Pricing changes. We may adjust the Naira-to-credit exchange rate at any time. Changes apply to future top-ups only; credits already purchased are unaffected.

5. Acceptable Use

You agree to use the Platform only for lawful purposes. You must not:

• Upload audio or video you do not own or have explicit rights to transcribe;
• Attempt to reverse-engineer, scrape, or exploit the transcription or AI systems;
• Use the Platform to generate, distribute, or promote illegal, defamatory, obscene, or hateful content;
• Upload content that violates a third party's copyright, trademark, or privacy rights;
• Interfere with the Platform's security, stability, or availability (including injection attacks, credential stuffing, or rate-limit bypass);
• Share your account or sell credits to other users;
• Use automated scripts to bulk-transcribe content for resale without a commercial licence agreement with us.

Violation of this section may result in immediate account suspension without refund, and may be referred to law enforcement where appropriate.

6. Anti-Fraud & System Integrity

Any attempt to manipulate payment callbacks, forge Paystack webhook data, tamper with credit balances, or gain access to another user's account or data is strictly prohibited. Such actions constitute fraud and may be prosecuted under the Cybercrimes (Prohibition, Prevention, Etc.) Act 2015 of Nigeria.

We log all payment events, session activity, and API calls. Suspicious activity is flagged automatically and reviewed by our team. We cooperate fully with law enforcement investigations.

7. Intellectual Property

Your content. You retain full ownership of any audio or video files you upload and all transcripts generated from them.

Our platform. All software, design, branding, and AI workflows powering the Platform are owned by Always Green Dev. You may not copy, resell, or redistribute any part of the Platform without written permission.

AI-generated SEO content. Titles, descriptions, hashtags, and chapters generated by the SEO Pack feature are provided for your use without restriction, but are not independently verified for accuracy or copyright clearance. You are responsible for any content you publish.

8. Privacy & Data

By using the Platform you consent to our collection of registration details, uploaded file metadata (we do not store audio/video files beyond the transcription process), usage logs, and payment records. Data is stored on servers within our hosting environment and is not sold to third parties.

Transcripts are stored and associated with your account so you can access them later. You may delete your transcripts from your dashboard at any time.

9. Service Availability & Accuracy

We strive for high uptime but do not guarantee uninterrupted access. The Platform may experience downtime for maintenance or due to factors beyond our control. We are not liable for any loss resulting from downtime.

AI transcription accuracy varies by audio quality, accent, background noise, and speaker count. We do not warrant that transcripts are 100% accurate. You are responsible for reviewing and correcting AI-generated content before using it for official, legal, or commercial purposes.

10. Limitation of Liability

To the maximum extent permitted by Nigerian law, we shall not be liable for: indirect or consequential losses; loss of data; loss of business or revenue; or any loss arising from your use of AI-generated content. Our total liability to you in any calendar month shall not exceed the value of credits you purchased in that same month.

11. Termination

You may close your account at any time by contacting support. We may suspend or terminate your account immediately for breach of these Terms, with no obligation to refund unused credits.

Upon termination, your transcripts and SEO packs will be deleted within 30 days.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute shall first be attempted through good-faith negotiation. If unresolved, disputes shall be referred to the courts of competent jurisdiction in Nigeria.

13. Changes to These Terms

We may update these Terms at any time. Material changes will be notified via email or an in-app notice at least 7 days before taking effect. Continued use of the Platform after a change constitutes acceptance of the revised Terms.
